Terms & Conditions

1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. Information on how to enter the competition and details of prizes can also be found on the promotional material.

2. This promotion is conducted by Gerber Scientific International Australia Pty Ltd, trading as Spandex Australia, 9 Hamley Road, Mt Kuring-Gai, NSW, 2080, ABN: 5508 8162 038.

3. The WIN a SONY HD TV Competition is open to all residents of Australia aged 18 years and over; except the directors, management and employees of the promoter, its related companies suppliers, agencies, associated with the competition, and the immediate families of the aforementioned persons.

4. Competition opens 8.00am Wednesday 1st June 2011 and closes 5pm Wednesday 31st August  2011. Purchases of Avery Graphics branded products over the value of $300.00 (excluding GST) are eligible during this period.

5. Entries will be automatically allocated every time a purchase of $300.00 (excluding GST) or more in value is made, through Spandex Asia Pacific (Distributor); of any Avery Graphics branded products. Purchases over $300.00 (excluding GST) will receive one (1) entry. Product is to be purchased for no more than the Distributors published retail price. Entries will be allocated to a customer even if the product is not available and a back order is required.

6. Purchases over $300 (excluding GST) or more in value, through Spandex Asia Pacific (Distributor);  of Avery Graphics materials that contain Avery Graphics Cast materials will automatically be allocated one (1) additional entry. Product is to be purchased for no more than the Distributors published retail price. Entries will be allocated to customer even if product is not available and back order is required.

7. Entrants (including winners) in the competition may enter as many times as they like.

8. The prizes will be drawn at 12:00 pm Monday 5th September  2011 at Spandex Asia Pacific Head Office, 9 Hamley Road, Mt Kuring-Gai, NSW, 2080. Draw will be supervised by independent scrutineer. Finalist will be notified by telephone by close of business Wednesday 7th September 2011, with a written confirmation by post or email.   All decisions of the Promoter are final and no discussions or correspondence will be entered into.

9. The winners will receive a Sony Bravia 40” HD LCD TV to the value of $1,599 (excluding GST) RRP.

10. Two (2) prizes will be awarded per state group. State Groups are defined as follows; G1:NSW/ACT; G2:VIC/TAS; G3:QLD; G4:WA; G5:SA/NT. Ten (10) Sony Bravia 40” HD LCD TV’s in total will be awarded as prizes for this competition.

11. The total National prize pool is valued at $15,990 (excluding GST). The Prize pool for each State Groups is as follows: G1 is valued at $3198 (excluding GST); G2 is valued at $3198 (excluding GST); G3 is valued at $3198 (excluding GST); G4 is valued at $3198 (excluding GST); G5 is valued at $3198 (excluding GST). Prices can change and the value may be less at the time of delivery. The promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

12. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.

13. Prizes cannot be transferred, or be redeemed for cash.

14. Winners will be notified by telephone, in writing and details of all prize winners will be published in The Australian newspaper on Wednesday 7th September 2011.

15. In the event that a prize is not claimed by the original winners or the original winners cannot be contacted by Wednesday 7th December 2011 a redraw will take place on Friday 9th December  2011. The redraw will take place at 12.00pm Friday 9th December  2011 at Spandex Asia Pacific, 9 Hamley Road, Mt Kuring-Gai, NSW 2080, by an independent scrutineer. The redraw winners will be notified by telephone, in writing and details of prize winners will be published in The Australian newspaper on Wednesday 14th December 2011.

16. By accepting the prize, the winner agrees to publish their name (first name and initials of surname only) and suburb, participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed.

17. The prize winners will be included in promotional material following the final results. Purchase and entry information will remain confidential.

18. The promoter’s decision is final. Prizes are not transferable or exchangeable and are not redeemable for cash.
 
19. The promoter, its contractors, employees and agents, will not be liable for any claims, losses, damages, injuries, costs and expenses suffered, sustained or incurred (including but not limited to indirect or consequential) as a result of, arising out of or in any way connected with the competition and /or its prizes, except for liability that cannot be excluded by law. Tax implications may arise from the receipt or use of a prize. Independent financial advice should be sought.

20. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
